Terms & Conditions of Sale

1. Ticket License

This ticket or wristband is a personal, revocable license issued by 1763229 Ontario Corporation operating as Prom Night Canada or PromNight.ca (the “Corporation”). Such license grants the holder admission to the specified event. Tickets and wristbands remain the property of the Corporation at all times.

All tickets and wristbands are non-refundable, non-transferable, and non-replaceable in the case of loss, theft, or destruction. All sales are final. Tickets are valid only for the event date specified and have no cash value. Tickets may not be resold, transferred, duplicated, or otherwise distributed without the express authorization of the Corporation. Tickets that are duplicated, resold, fraudulently obtained, or otherwise acquired in violation of these Terms and Conditions of Sale may be cancelled or voided without refund.

The Corporation reserves the right to cancel or refuse any ticket order that appears suspicious, fraudulent, or made in violation of these Terms and Conditions of Sale.

2. Event Changes

Events are subject to change without notice. The Corporation reserves the right to modify event details including, but not limited to the venue, schedule, programming, entertainment, or operational elements of the event. Such changes do not entitle the ticket holder to a refund or compensation.

The Corporation may postpone, cancel, interrupt, or stop the event due to adverse weather, dangerous situations, public health concerns, government orders, labour disruptions, venue issues, or any other circumstance beyond the reasonable control of the Corporation or its partners, subcontractors or co-promoters. If the event cannot be held as originally scheduled due to circumstances beyond the control of the Corporation or its partners, subcontractors or co-promoters, the Corporation may make reasonable efforts to reschedule the event to a different date or materially different time. A ticket holder who is unable to attend a rescheduled event will not be entitled to a refund.

3. Entry, Security, and Prohibited Items

Admission to the event is subject to security screening. The ticket holder agrees to submit to reasonable security measures prior to entry, which may include bag checks, inspection of personal belongings, and physical screening including a pat-down search. Refusal to comply with security procedures may result in denial of entry without refund.

The following items are prohibited on shuttle buses and at event venues. Any such items will be confiscated by the Corporation, partners, agents, subcontractors, co-promoters, or venue staff and will not be returned to the attendee:

  • Alcoholic beverages brought from outside the event
  • Illegal drugs or drug paraphernalia
  • Weapons of any kind
  • Fireworks or firecrackers
  • Outside food or beverages
  • Bottles, thermoses, or containers
  • Animals (except permitted service animals)
  • Large bags or backpacks
  • Any item deemed unsafe or inappropriate by event staff

Once admitted to the event, there are no in-and-out privileges.

Smoking or vaping may be permitted, but only in designated areas where permitted by the venue and applicable laws. Attendees who smoke or vape outside of designated areas may be subject to refusal of service and removal from the event without refund.

4. Alcohol Policy

Prom dinner events organized by the Corporation are strictly alcohol-free events.

Alcohol is strictly prohibited on all shuttle buses and may not be brought into event venues.

Certain After Prom events may take place at licensed venues in the Province of Quebec, where alcohol service may be available. After Prom events remain all-ages events; however, alcohol will only be served to attendees who meet the legal drinking age in Quebec and present valid government-issued identification. Identification may be requested and checked at any time by the Corporation, its partners, venue staff, security personnel or other authorized representatives. Refusal to comply may result in refusal of service and/or removal from the event without refund.

Any attempt to purchase or obtain alcohol while underage or any misrepresentation of age or use of false identification is the sole responsibility of the attendee and may result in refusal of service and/or removal from the event without refund.

Attendees must behave in an orderly manner; intoxication, disruptive, or inappropriate behavior may result in eviction without refund. The Corporation reserves the right to refuse alcohol service or remove any attendee who appears intoxicated, attempts to supply alcohol to minors, or violates alcohol-related policies.

5. Transportation

After Prom tickets include shuttle bus transportation to and from the event where applicable. Transportation services are provided by independent third-party charter bus operators. The Corporation is not responsible for transportation delays, mechanical issues, traffic conditions, or other circumstances affecting transportation services. Transportation delays or issues do not qualify for refunds.

All event rules and conduct standards apply while on shuttle buses. Attendees who engage in unsafe, disruptive, or inappropriate behaviour may be removed from transportation services or the event without refund.

6. Conduct and Removal from Event

Attendees are expected to conduct themselves in a respectful and safe manner. The Corporation reserves the right, without refund or compensation, to seize or cancel a ticket, withdraw the license granted herein, refuse admission, or remove any attendee whose conduct is deemed unacceptable.

Prohibited behaviour includes, but is not limited to:

  • Disorderly conduct
  • Verbal or physical abuse
  • Harassment or discrimination
  • Violence or threats of violence
  • Vandalism or damage to property
  • Possession of prohibited items
  • Supplying alcohol to minors
  • Refusal to comply with instructions from event staff, security, or venue personnel
  • Refusal to comply with these Terms and Conditions of Sale

The Corporation reserves the right to report incidents of misconduct to the attendee’s school administration, parents or guardians, and where appropriate, law enforcement authorities.

7. Photography, Video, and Media

Attending an event means you consent to being filmed or photographed, granting the Corporation the perpetual, and irrevocable right rights to use your image, voice and likeness without compensation and to use any photographs, video or audio recordings taken at the event by the Corporation, its partners, agents, entertainers, employees, contractors or subcontractors. Such content may be used for promotional, marketing, advertising, or archival purposes in any media now known or later developed.

Attendees may not engage in commercial filming, recording, or livestreaming of the event without the prior written consent of the Corporation.

Security cameras and surveillance systems may be in use at event venues and transportation locations.

8. Assumption of Risk

The ticket holder voluntarily assumes all risks, dangers and hazards associated with attending an event and participating in related activities, including transportation provided in connection with such event. These risks include, without limitation, the risk of personal injury, illness, property loss, property damage, or other harm occurring before, during, or after the event.

9. Limitation of Liability

To the fullest extent permitted by law, the Corporation, its officers, directors, owners, employees, agents, entertainers, contractors, subcontractors, co-promoters, partners, affiliates and assigns shall not be liable for any injury, loss, damage, or claim arising out of or related to attendance at and event. In all circumstances, the total liability of the Corporation shall be limited to the face value of the ticket purchased.

10. Indemnification

The attendee agrees to indemnify, defend, and hold harmless the Corporation and its officers, directors, owners, agents, entertainers, employees, contractors, subcontractors, co-promoters, partners, affiliates and assigns from and against any and all claims, damages, liabilities, and costs arising from the attendee’s breach of these Term, breach of any applicable law or regulation, violation of the rights of any third-party or misconduct at an event.

11. Privacy

Ticket purchases and event participation are subject to the Corporation’s Privacy Policy, which is available on the Corporation’s website. By purchasing a ticket or attending the event, the ticket holder consents to the collection and use of personal information in accordance with that policy.

12. Governing Law

These Terms and Conditions of Sale shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, regardless of the location where the event takes place.

13. Severability

If any provision of these Terms and Conditions of Sale is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of the remaining provisions.

14. Changes

The Corporation may update these Terms and Conditions of Sale from time to time to reflect operational, legal, or regulatory changes. Updates will be posted on this page and will take effect when published. Please check these Terms and Conditions periodically for updates.
